Terms & Conditions of Sale

Last updated: 18 October 2026

These are the terms on which BREAK HARD LTD sells electric off-road bikes and accessories to you. Please read them before you order — by placing an order you agree to them.

The most important thing on this page: every machine we sell is an off-road vehicle only. None of our bikes are legal to ride on a public road, pavement, or any public space without the correct registration, tax and insurance. You must be 18 or over to buy from us.

1. Who we are

"We", "us" and "our" mean BREAK HARD LTD. "You" means the customer placing the order. These terms apply to consumers — if you are buying in the course of a business, contact us first, as different terms will apply.

2. Ordering and how a contract is formed

Our website pages are an invitation to buy, not a binding offer.

  1. You choose a bike and review the order page showing the specification, the total price and who you are paying.
  2. You tick the confirmation that you are 18 or over and understand these are off-road machines, then submit your order or invoice request.
  3. That submission is your offer to buy.
  4. A contract is formed only when we accept it in writing — by email confirmation or by sending you an invoice. If we cannot accept your order (for example a model is out of stock or the specification has changed), we will tell you and you will pay nothing.

Please check your confirmation email carefully. If any detail is wrong — the model, the specification, your delivery address — tell us straight away at orders@brakehard.co.uk.

Product images are for illustration. Colours can vary between screens and between production batches. We describe every machine as accurately as we can, and the written specification in your order confirmation is the specification that applies.

3. Price and payment

  • All prices are in pounds sterling (GBP) and include all applicable taxes. Nothing extra is added at checkout.
  • Delivery within the UK is free. See our Delivery page for what that covers.
  • Build your own is available on the M7 and is included in the price — there is no separate charge for personalisation, and the price you see is the price you pay.
  • There are no hidden fees, card surcharges or handling charges.

How to pay

We accept payment on our secure payment page — bank transfer, or card where enabled. The name that will appear on your bank statement is BREAK HARD LTD.

We will never ask for your card details over email, text message or the phone. Pay only to the account details shown on your official Break Hard invoice. If anyone contacts you claiming to be us and asks for card details, or gives you different bank details, do not pay — call us first on 0800 654 6845.

We begin preparing your build as soon as your payment clears — usually the same working day, and always within one working day of your order. Your statutory delivery period runs from the day you place your order.

4. Delivery

  • UK delivery is free, tracked, and usually takes 14–21 working days from the day you order — and we will always deliver within 30 days of your order.
  • Bikes are shipped boxed and approximately 90% pre-assembled. You will need to complete final assembly and safety checks — see section 8.
  • We email tracking as soon as your order leaves the warehouse.
  • Risk in the goods passes to you when they are delivered to the address you gave us.

Full details are on our Delivery page.

5. Your right to cancel (14 days)

Because you are buying at a distance, you have a legal right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

  • You have 14 days from the day you receive the bike to cancel, for any reason, without giving an explanation.
  • Tell us you want to cancel in writing — email orders@brakehard.co.uk or use the model cancellation form below.
  • Send the bike back within 14 days of telling us. We can arrange collection or tell you how to return it.
  • We refund you within 14 days of receiving the goods back, or of you proving you sent them — whichever is earlier.
  • We refund to the method you used to pay.
  • You are responsible for the cost of returning the bike, unless we agree otherwise. We will tell you the likely cost before you commit to returning it.
  • You must take reasonable care of the bike while it is in your possession. You can inspect it as you would in a shop, but if you use it beyond that we may deduct an amount for any loss in value. Personalising your M7 means the machine can no longer be returned in a resalable condition — see below.

A personalised M7 cannot be cancelled. Goods made to your specification or clearly personalised are exempt from the 14-day cancellation right. Once you confirm a design with your name, number and colours, that machine is built for you and cannot be resold, so the exemption applies to the whole bike. There is no separate personalisation charge to withhold — personalisation is included in the price. If you order an M7 without personalisation, your full 14-day cancellation right applies.

Model cancellation form

You do not have to use this form — any clear written statement works — but you may use it if you prefer:

6. If something is wrong with your bike

Separately from your right to cancel, the Consumer Rights Act 2015 says goods must be of satisfactory quality, fit for purpose, and as described. If your bike does not meet those standards:

When you noticeWhat you are entitled to
Within 30 days of deliveryReject the bike and get a full refund. We may ask you to let us repair or replace it first if that is quicker and costs you nothing.
After 30 days, within 6 monthsRepair or replacement. If that is impossible or disproportionate, a price reduction or a final right to reject.
After 6 months, within 6 yearsRepair or replacement, but you may need to show the fault was there when the bike arrived.

If a fault is our responsibility, we cover the cost of returning the bike and the cost of the repair or replacement. Report faults as soon as you notice them — see Returns & warranty for how.

7. Warranty

Alongside your statutory rights, we provide a 2-year warranty on the frame and electrical drive system (motor, controller and battery) from the date of delivery, covering manufacturing defects.

The warranty does not cover: normal wear and tear (tyres, brake pads, chain, sprockets, cables, bearings, suspension seals); accidental damage or crash damage; damage from misuse, overloading, competition or stunt riding; water ingress from jet washing; unauthorised repairs or modifications; damage caused by incorrect assembly or by using non-approved chargers, batteries or parts; and cosmetic deterioration such as scratches and fading.

The warranty is in addition to your legal rights and does not replace them. Full details are on the Returns & warranty page.

8. Off-road use, safety and your responsibilities

Our machines are off-road vehicles and are not road legal. Riding them on a public road, pavement or other public space without registration, tax, insurance and a valid licence is an offence. You accept full responsibility for how and where you use the bike, for any legal consequences, and for any injury or damage caused.

  • You confirm you are 18 or over and that you have the right to buy and use this product in your location.
  • Youth models — the Teenage, built on the Surron Hyper Bee — are sold to adults only. They are intended for use by riders under 18 only under the supervision of a responsible adult, on private land and with the landowner's permission. The adult who buys the machine is responsible for ensuring the rider is competent, is wearing suitable protective equipment, and is riding within the law. We do not sell to under-18s and will not accept an order placed by a minor.
  • Our bikes are supplied boxed and partly assembled. Final assembly and a safety check must be carried out before first use — by you if you are competent to do so, or by a qualified mechanic if you are not. Incorrect assembly can cause serious injury.
  • Always wear a suitable helmet and protective equipment. Check brakes, tyre pressure, wheel fixings and the battery before every ride.
  • Never charge the battery unattended, overnight, or near anything flammable. Follow the charging instructions supplied with the bike.
  • Lithium batteries must not be disposed of in household waste. Contact us for guidance on recycling.
  • Batteries should not be charged below 0 °C.

9. Our responsibility to you

We do not exclude or limit in any way our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud, and for your statutory consumer rights.

We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss that is not foreseeable, or for business losses (such as lost profits, lost business or business interruption) where you are using the product for commercial purposes.

We are not liable for damage or injury arising from your use of an off-road vehicle on a public road or in any other way that is unlawful, or from failure to carry out the required final assembly and safety checks or to follow the supplied instructions.

10. Complaints and disputes

If you are unhappy, please contact us first — most things are sorted out quickly by phone or email. We will acknowledge your complaint and keep you updated while we investigate.

We are not obliged to use, and do not currently agree to use, an alternative dispute resolution (ADR) provider for consumer disputes. You retain the right to take a dispute to court.

11. General

  • We may update these terms from time to time. The terms that apply to your order are the ones published when you placed it.
  • If any part of these terms is found to be invalid, the rest remains in force.
  • A person who is not a party to the contract has no right to enforce any term of it.
  • These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can bring proceedings in your own courts.
